Terms of Service

These Terms of Service (“Terms”) govern access to and use of mogaem.com and the Moga’em BTEC Assessor product. By creating an account or using the service, you agree to these Terms and our Privacy Policy.
1. The service
Moga’em provides web software for BTEC teachers and coordinators, including tools such as Criteria Decoder, Evidence Mapper, evaluation and assessment-record workflows, on-screen review and consistency helpers, IV-oriented views, a workspace PDF trimmer, season credit wallets, and related dashboards.
We also offer free public browser-only PDF split/trim and merge tools that do not require an account. Those tools do not store your files on our servers.
Features may change as we improve the product. Some tools consume credits; cached or free paths are described in the product UI where applicable.
2. Eligibility and accounts
You must be able to form a binding contract and use the service for professional education purposes. You are responsible for safeguarding your login credentials and for activity under your account.
Provide accurate registration information. You must not share your account in a way that violates your institution’s policies or these Terms.
3. Acceptable use
You agree not to misuse the service. Without limitation, you must not:
- Upload or process learner or institutional materials without appropriate authority and lawful basis.
- Attempt to access another user’s data, probe or disrupt systems, or bypass authentication, billing, or credit controls.
- Use AI outputs as a substitute for your professional judgement where awarding-body or institutional rules require human assessment decisions.
- Reverse engineer the service except where applicable law allows, or use the service to build a competing product by systematically extracting our content or models.
- Use the service for unlawful, harmful, or misleading purposes.
4. AI-assisted outputs and professional responsibility
AI features produce assistive drafts, decoded wording, evidence locations, or chat replies. They can be incomplete or incorrect. You remain solely responsible for assessment judgements, feedback issued to learners, IV decisions, and compliance with Pearson/BTEC and centre policies.
Evidence Mapper and similar tools are designed to locate candidate evidence; they do not replace teacher confirmation of sufficiency.
5. Credits, subscriptions, and billing
Paid plans and on-demand credit packs are sold through Polar.sh. Prices, inclusions, and season windows are shown on the pricing pages at the time of purchase.
Season credits generally apply for a teaching-season window described in the product. Unused credits do not automatically roll into a new season unless we expressly state otherwise at purchase.
Taxes, currency, refunds, and payment method rules may be set by Polar and applicable law. Contact support@btec-assessor.com for billing help after checking your Polar customer portal where available.
6. Your content and licence to us
You retain rights in materials you upload (student work, specs, notes). You grant us a limited licence to host, process, transmit, and display that content solely to operate the features you use—including sending necessary excerpts to AI processors as described in the Privacy Policy.
You represent that you have the rights and permissions needed to upload and process that content.
7. Our intellectual property
The Moga’em name, product UI, documentation, and software (excluding your content) are owned by us or our licensors. These Terms do not transfer ownership to you.
BTEC is a trademark of its respective owner. We are not affiliated with or endorsed by Pearson unless explicitly stated.
8. Public PDF tools
Public PDF tools are provided free of charge, as-is, for convenience. Processing happens in your browser. You are responsible for the files you select and for verifying the downloaded output before relying on it.
9. Availability and changes
We aim for reliable uptime but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice when practical.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI OUTPUTS WILL BE ACCURATE OR THAT THE SERVICE WILL MEET YOUR INSTITUTION’S AUDIT REQUIREMENTS WITHOUT YOUR REVIEW.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service.
Our aggregate liability for claims relating to the service in any twelve-month period is limited to the greater of (a) the amounts you paid us for the service in that period or (b) fifty US dollars (or local currency equivalent), except where liability cannot be limited by law.
12. Suspension and termination
You may stop using the service at any time. We may suspend or terminate access if you breach these Terms, create risk for other users, fail to pay, or if we must do so for legal or security reasons.
Provisions that by nature should survive (including intellectual property, disclaimers, and limitations of liability) survive termination.
13. Governing law
Unless mandatory local consumer law says otherwise, these Terms are governed by the laws applicable to our operation of the service, and disputes will be handled in a competent forum connected with that operation. Nothing in this section limits rights you may have as a consumer in your country of residence.
14. Changes to these Terms
We may update these Terms. We will revise the “Last updated” date when we do. Continued use after changes become effective constitutes acceptance where permitted by law.
